LAKES PROPERTY SOLUTIONS TERMS AND CONDITIONS

1. The client will be responsible for all payments, including shared fences to LAKES PROPERTY SOLUTIONS unless otherwise notified in writing prior to commencement. If being financed by your bank, a letter is required from the bank stating how much funds are available prior to commencement and deposit needs to be received by LAKES PROPERTY SOLUTIONS before ANY work starts.
2. The client shall provide water and electricity, if required to complete works, at no charge to, LAKES PROPERTY SOLUTIONS
3. The client shall provide access to site during, LAKES PROPERTY SOLUTIONS normal working hours and storage space, if required, for materials during the contract progress.
4. Any addition and/or alterations to the schedule shall be properly treated as variations and subject to written instructions.
5. LAKES PROPERTY SOLUTIONS is not able to accept responsibility for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to us in writing or apparent on visual inspection.
6. Down payment(s) of 25%-50% is payable with order in certain situations, will be specified on contract.
7. We reserve the right to charge 10% for any outstanding invoice not paid in full by the due date.
8. Stage payments of against works completed/materials on site to be made as per agreed arrangement prior to commencement. Final payment to be made following completion and payable within 3 days of our invoice.
9. Any variations to the agreed quote will be charged at $50 per change, plus any costs for that item.
10. Price to remain fixed until the end of the 6th week of quotation given. Acceptance before that date will ensure no increase in the cost of the works specified in the quotation.
11. All, or any special conditions, of which LAKES PROPERTY SOLUTIONS has been informed are noted in the quotation.
12. It is very important and the responsibility of the Client to ensure we are made aware of any special/statutory Bylaws/Conditions/Permissions that may be involved.
13. We accept no responsibility for works that have been carried out on land that is not under the ownership of the client and it is assumed that all planning laws or regulations have been applied before commencement of any works.
14. We are not able to accept responsibility for the well being and maintenance of living plant material, including turf, following practical substantial completion unless a maintenance contract is in existence.
15. If necessary we reserve the right to substitute any plant with another of equal value and growth/habitat/colour in accordance with the specification.
16. After practical substantial completion, we are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any material(s) including plants.
17. Upon practical substantial completion the responsibility for the care and watering of all plants, lawns, etc., is handed over to the client and will require regular attention until established.
18. Severe weather conditions, including drought, may cause the delay of the start date of the contract.
19. Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstances.
20. All materials on site remain the property of LAKES PROPERTY SOLUTIONS until payment is received in full.
21. Maintenance is not included in the contract unless specified.
22. We reserve the right to change these terms and conditions at any time.
